OUR INSPIRATION
I met Martin and the guys just under a year ago. Before knowing them I had never known an avid biker and my only knowledge of bike culture came from the little I had seen on TV. I thought being a biker was all about the women, beer, and fancy bikes, and it is... But its also very much about camaraderie. Never before have I seen a group so unified and supportive of each other. I have no doubt that is the main reason why Martin Resendez and the entire crew of "Rolling Deep 4 Charities" have been able to accomplish so much. 
In just this year alone they helped thousands with 3 major charity runs. The first being the "Spread the Warmth - La Mission Run" where over 400 Bikers collected and distributed jackets and blankets to the homeless living on skid row. Shortly after, they organized the "Ramona Gardens Christmas Toy Run" where they gave toys to kids living in the projects of Boyle Heights. In July they had their largest ever "Rosarito Harley Run" where over 900 bikers crossed the Mexican border to help the impoverished community living just hours outside of Los Angeles.

Sons of Anarchy meets Extreme home Makeover. We want to take the exciting subculture of bikers and infuse it with a heartfelt reality that everyone can relate to.

The entire amount raised will be used to pay for the post-production of our promo. This will include paying an editor, sound mixer, and colorist.

By financing our project through crowd-funding we are able to avoid using any funds from the charity that uses all its resources directly for those in need.

Feds to Motorcyclists: Pump E-15 into your bike and go to jail.
The Motorcycle Riders Foundation (MRF) reports that according to the Environmental Protection Agency (EPA) using ethanol blends of 15% ethanol in any vehicle that is not a passenger vehicle will be in direct violation of Federal law. The EPA has issued a list of possible plans to mitigate mis-fueling issues with the recently approved E-15 ethanol blends. Prior to E-15, the highest blend allowed for mass consumption was E-10. The MRF has been informing the EPA that the higher blend will be forced upon motorcyclists because of the remaining fuel in the hose from the previous customer. The EPA then said that a 4 four-gallon minimum purchase would be required by everyone. That was rolled back and an EPA document specifically mentions the work of the motorcycle rights organizations in the overturn of the mandatory minimum.
From the EPA: "However, groups representing motorcycle owners and lawn mower manufacturers objected to this configuration because their products have gas tanks that are normally two gallons or smaller. In response to these concerns, Renewable Fuel Standard (RFS) developed and proposed a new configuration for EPA approval that retail stations may use as an alternative to the currently approved configurations."
The solutions provided by the EPA is to label the pumps with attention getting labels that you are about to pump E-15 into your vehicle. Or purchase new blender pumps that only carry about .3 gallons or have a new pump with a dedicated E-15 hose. The first solution won't work and the second two solutions are too expensive.
In another recent EPA document on the Renewable Fuel Standard (RFS) the EPA states: "The EPA will propose to use flexibilities in the RFS statute to reduce both the advanced bio fuel and total renewable volumes in the forthcoming 2014 RFS volume requirement proposal."
The EPA also maintains that while ethanol will be the dominating renewable fuel, the marketplace for them is shrinking fast.
In a recent Wall Street Journal piece the author, US Representative Patrick Meehan, pointed out that the EPA's position on the RFS was weak; "refusing to take action this year is a far too tepid response to this crisis. Next year may be too late." said Representative. Meehan.
In order to stop the onslaught of higher ethanol blends the Motorcycle Riders Foundation asks that you support this important piece of legislation. HR 875 is a bill that would stop the sale of E-15 and includes a study on the actual effects on the power train of your vehicles.

Clay County authorities wanted to use an annual motorcycle gathering Saturday in rural Kearney to send a clear message: Law-abiding motorcycling enthusiasts are welcome, but those with other plans should stay away. 

But organizers of the Mule Run gathering said law officers unfairly targeted people headed to a longtime, peaceful event that raises money for local charities.

Lt. Will Akin of the Clay County Sheriff’s Department said the crackdown came after authorities learned that several rival motorcycle gxxgs want to set up criminal operations in the county and were planning to attend the overnight event.

“No one has territory here, and they wanted to stake their claim,” Akin said. “Now they’re rolling in, trying to show a presence to establish their territory.”

Authorities said they expected the event to attract members of the Galloping Goose, Bandidos, Sons of Silence, Mongols, Boozefighters and Hells Angels, Akin said.

On Saturday, authorities ran heavy traffic enforcement at Interstate 35 and Missouri 92 in Kearney and along routes from Liberty to Holt. Sheriff’s deputies, police and the Missouri Highway Patrol pulled over cars, pickups and motorcycles for various traffic violations. 

Police radios crackled with alerts of large groups of approaching motorcyclists while a police helicopter hovered overhead.

“What we hoped is they got the picture that we were out there and if they were breaking the law, then we were going to pull them over,” Akin said. “We had zero tolerance.”

Authorities arrested at least two people, but they would not say Sunday how many vehicles they stopped. They have scheduled a media briefing for 9 a.m. today.

Event organizers said the police presence was excessive.

“It definitely was profiling,” said one of the organizers, who asked that he not be identified because of the law enforcement crackdown. “We’ve had this event for the past 20 years, and we have never had any problems.”

Clay County authorities said they wanted to prevent the kind of criminal activity that emerged earlier this summer in Omaha, Neb., when a 48-year-old man was found shot to death inside a Hells Angels clubhouse.

In unincorporated Clay County, gxxg activity has steadily increased, Akin said.

The annual gathering on Saturday was at a home near the Jesse James Farm. Participants, who had to be at least 21 years old, enjoyed live music, plenty of food, beer, a bonfire and a fireworks display.

Organizers said proceeds from the event support local charities, including those that help military combat veterans and children with disabilities.

Countless motorcycles were parked throughout the property. Tents filled the front lawn and also were scattered throughout the property. A stage featuring a Confederate flag stood nearby, along with a host of portable toilets.

In years past, neighbors complained about loud music and illegal parking.

Neighbor Judy Murphy said she knows local residents who have attended the event, and she hasn’t seen problems.

“You’ll hear the music, and you’ll see them all camped out,” Murphy said. “They’re a good group of people; they’ll wave when they go back and forth.”

Aftershow will stream three times during 'SOA's' sixth season


FX’s “Sons of Anarchy” is getting into the aftershow biz already capitalized upon by dramas including “The Walking Dead” and “Breaking Bad.”
Unlike “Talking Dead” and “Talking Bad,” however, “SOA’s” aftershow — titled “Anarchy Afterword” — will take place live online. Aftershow, to be hosted by Chris Franjola, will feature uncensored interview with “SOA” creator Kurt Sutter and a revolving panel of cast members and celeb guests. Fans will be able to lob their own questions to the creatives via call-in, Twitter and Facebook.
The CW teamed for Machinima for a similar web aftershow for frosh drama “Cult” earlier in the year.
“Anarchy Afterword” will bow on Sept. 10 at 11:30 p.m. ET, 8:30 p.m. PT and stream live from the “SOA” set athttp://www.anarchyafterword.com. “Afterword” is slated to stream live three times during “SOA’s” sixth season — after the season premiere, episode five on Oct. 8, and the finale on Dec. 10.

'2 Million Bikers' Cruising Through D.C. on 9/11 Despite Permit Denial

Washington DC - ~Police will act against the bikers if 'a crime' is committed~ Bikers hoping to cruise nonstop through Washington, D.C., on Wednesday, Sept. 11 received disappointing news over the weekend: the city denied their permit request.
"We find this regretful for the residents and businesses of that great city, and humbly offer our apologies," organizers of the ride said Friday on Facebook. "What could have been a one or two hour ride through will now likely be an all day event."
It's legal for motorcycles to drive through D.C. and participants plan to cross into the capital undeterred after 11 a.m. "For security purposes the final route will not be posted publicly," the organizers added.
It's unclear if law enforcement will take action against what may be a traffic-clogging permitless demonstration on wheels.

Riders plan to abide by all relevant traffic laws, such as yielding to pedestrians and stopping at red lights.
But a member of the D.C. police department's public affairs office told U.S. News officers will act "if there is a crime committed."
It would be a crime for riders to engage in certain activities "if a permit is required" for them, according to the police spokesman.
The ride is intended as a way to remember the people who died in the 9/11 terror attacks and the soldiers who subsequently fought al-Qaida in Afghanistan. It was announced in August, after a Sept. 11 demonstration originally billed as the "Million Muslim March" – but renamed the "Million American March Against Fear" in February – received widespread media coverage.

The Muslim-initiated demonstration received a permit from the National Park Service for use of the National Mall. Its participants will include groups that doubt the official account of the 2001 terror attacks, at least one tea party organization, Princeton professor Cornel West and Congressional Black Caucus Chairman Rep. Emanuel Cleaver, D-Mo.
Bike riders are already en route from across the country. Local press reports said bikers whizzed through Florida and Texas Sunday on their way to D.C. Photos posted to Twitter show meetups in Phoenix, Knoxville, Tenn., and Maine. Organizers set up Facebook groups to help organize participants from each of the 49 continental states.
Ted Gest, a spokesman for the D.C. attorney general's office, which would prosecute alleged infractions, did not immediately respond to a request for comment.

What is RICO,
and Why the Feds started using it Against Bikers

Today, governments and their agencies worldwide are classifying their "Biker" populations as undesirable criminal organizations, slating them for harassment and selective prosecution. Our governments are blatantly determined to eradicate the biker lifestyle.
I will attempt to show how all of this began, and how RICO is connected to the U.S. government's "war on motorcycle clubs." No matter where you live, this "War On Motorcycle Clubs" is a serious threat is to our individual constitutional and human rights as citizens of our respective countries.

In 1961, during the John F. Kennedy administration, the office of Attorney General was held by his brother Robert Kennedy. With help from the U.S. Congress, Attorney General Kennedy got a special organized crime bill passed called the Racketeering Influence and Corrupt Organization Act of 1961 (RICO). This new law was designed to prosecute the secretive organized crime organizations such as the Mafia, Drug Cartels, and Domestic Terrorists.

The RICO Act was designed to allow Federal Prosecutors to go outside the normal rules of conduct to gain convictions. These new rules allowed the government to charge unconnected criminal acts committed by individual members of these organizations together in a single Indictment.
Since these organizations were classified as criminal organizations, all the prosecutor had to do was to persuade a jury that each of these independent criminal acts were somehow committed in furtherance of the organization's goals.
This helped establish the "Criminal Enterprise" to qualify as a RICO Act violation. The government could do this even though it was not necessary to prove any of the defendants knew or participated in the criminal acts of others charged in the RICO Indictment.
In 1980, former movie actor and governor of California Ronald Reagan was elected President of the U.S., with ex-CIA Director George Bush as Vice President. Soon after Reagan took office, he issued an Executive Order declaring America's top four Motorcycle Clubs to be classified as Criminal Organizations. This new classification added the motorcycle clubs to the list of traditional criminal organizations who could be easily prosecuted using the special RICO rules.
President Reagan ordered Attorney General William French Smith and his Justice Department to set up special regional task force headquarters across America. The Justice Department's mission was to profile and get the selected motorcycle clubs off the streets using whatever means necessary.
In my opinion, the reason behind President Reagan's Actions was his daughter's supposed involvement with the Hell's Angels Motorcycle Club. It doesn't seem to be just a coincidence that the Hell's Angels were the first Motorcycle Club the Justice Department went after using the RICO Act.
It seems obvious Ronald Reagan brought his own personal animosity against motorcycle clubs to the office of President. He then used the power of that office to pursue his personal vendetta against motorcycle clubs, using the broad RICO rules which almost guarantee conviction.
Over the last 30 years federal law enforcement agencies have expanded this selective prosecution to include more than 300 Motorcycle Clubs. These motorcycle clubs are now classified as "Outlaw Motorcycle Gangs/Criminal Organizations."
During my lengthy RICO sentence, I did extensive research and litigation in the courts. I’m fully aware of the uphill battle it will take to change the classification and profiling of the targeted motorcycle clubs, but it can be done. It is our constitutional right to be treated like any other citizen. The battle can be fought and won only in the courts.

In the Pipeline: A resurrected Hells Angel

"A cement-covered marshmallow."
That's how Katherine Coones describes her husband Rusty, a 6-foot-5 biker bear of a man who, despite what some might consider to be an intimidating presence, is disarmingly warm and engaging.
On Goldenwest Street right near the 405 Freeway is Illusion Motorsports, the world this couple (along with Rusty's business partner, Rodrigo Requejo) has been building for more than a decade. They call it "the premier motorcycle customizing shop of Orange County," and after a tour, it's obvious why.
Though they'll do tune-ups and other bike maintenance here, it's the design and building that they're primarily focused on. Several dozen bikes in various stages of creation and design are on display, including one $80,000 beauty that Rusty is customizing for a local businessman.
Over the thundering, metallic roar of motorcycle engines, Rusty beams as he leads our tour, stopping to kid with his employees and answer questions about works in progress.

In a second-story loft, a band rehearsal stage is set up with amps, drums and guitars. The name Attika 7 is emblazoned on a banner.
This is where our story starts to come together. Rusty Coones is a guitar player in a heavy metal band. He's also a Hells Angel, founder of the Orange County chapter and current head of the San Fernando chapter.
He's been an Angel for about 17 years, but we don't talk a lot about the Angels because there's a code about that. And that's fine.
In 1999, Rusty went to prison for conspiracy to distribute ephedrine. He was looking at two life sentences, but was sentenced to eight years and ended up serving six.
Rusty told me he could have had it a lot easier if he'd named names, but he wouldn't do that. Because that's not what Angels do. "I don't tell on anybody, ever," he said. "That's just not how I am."
While in jail — including a stint at New York's notorious Attica prison — Rusty said he thought about "all the stupid things I'd done, along with all the good things I'd done. I read a ton of books. And I decided when I was in there, if I ever got another shot at freedom, that I was going to do it the right way and never put my freedom on the line again."
He missed his kids (now 29 and 30) and his wife while he was in. And he rediscovered his childhood love of making music, so he started writing songs on guitar. Soon, he was playing concerts for the inmates, featuring his raw, heavy metal-based songs that reflected his two intense years in solitary confinement.

Just last week, the band Rusty created once he got out of prison, Attika 7, released its debut album, "Blood of My Enemies." The loft at Illusion Motorsports is the band's headquarters, where they practice, hang out and even play occasional shows for fans.
You may have already heard some of the band's music featured in the popular TV show "Sons of Anarchy."
Now, they're heading out on tour, in yet another improbable chapter in the life of Rusty Coones.
"I'm making the most of this second chance I have," he said. "Freedom, with honor, is worth more than anything, and I'm now running my life as honorably as I can.
"Hard work is what I live by now. Here in my shop, in my marriage and in my music. And any friends or family with drug issues, I try to help them. But I've learned that the key is, people have to want help before you can really get anything done."

Katherine told me that just before Rusty got arrested, they had started their bike business, and that she had to keep everything alive while he was in.
But at first, she could not even visit him in prison because they were not married yet. So they found a biker minister who performed the service over the phone — with Rusty on a prison pay phone — with permission from the judge.
She also said she knew he was worth waiting and fighting for, and that when she looked up at the sun and the moon and pictured him under those same bodies in the sky, it gave her hope.
She abstained from doing many things she liked doing until Rusty was free so they could enjoy them together, and today she's a very active partner at the shop.
"I was truly in love," she said, "and I still am. I glow when I am with him."
Katherine and her "cement-covered marshmallow" work hard as a couple to run their business. Rusty, also a former general contractor, actually built the loft his band plays in, and he's proud of how handy he is.
"I love to create things," he said. "This space for the band, and especially motorcycles. I look at every bike as a canvas."
Before I left the shop, Rusty stressed again, "If you're going to be free, you've got to be legit."
And for all he puts into his marriage, the shop and his music, he may just dedicate the most energy to that: being legit.

That was rolled back although the EPA later stated, "However, groups representing motorcycle owners and lawn mower manufacturers objected to this configuration because their products have gas tanks that are normally two gallons or smaller. In response to these concerns, Renewable Fuel Standard (RFS) developed and proposed a new configuration for EPA approval that retail stations may use as an alternative to the currently approved configurations."
The solutions provided by the EPA is to label the pumps with attention getting labels that you are about to pump E-15 into your vehicle. Or purchase new blender pumps that only carry about .3 gallons or have a new pump with a dedicated E-15 hose. The first solution won't work and the second two solutions are too expensive.
The EPA has also maintained that while ethanol will be the dominating renewable fuel, the marketplace for them is shrinking fast.
HR 875, authored by US Representative Patrick Meehan would stop the sale of E-15.   I respectfully urge your support of HR 875.

Part 2 in a two-part series

The sight of motorcyclists zooming down the roads around the province is becoming more common these days.

For the majority of riders, motorcycling is for the sheer enjoyment of it. Putting on leather jackets, leather chaps and gloves and hitting the open road gives people a sense of freedom and adventure.

But not all bikers are focused on fun.

For the tens of thousands of people who ride motorcycles, there’s a small group in this province believed to be associated with organized criminal activity.

They’re known as the one percenters — a term pegged decades ago that referred to the percentage of bikers who don’t follow society’s rules.

They proudly wear the “1%” insignia on their three-tier patches, which also shows their club name and chapter location.

Police call them Outlaw Motorcycle Clubs (OMCs) and both the RCMP and RNC are well aware of their existence in this province.

Gxxgs like The Outlaws and Bacchus in Grand Falls-Windsor, as well as a few in St. John’s, have drawn the attention of law enforcement, which have linked them to organized criminal groups in other parts of the country.

Outlaw biker gxxgs in Canada have become a serious problem for police and the general public, who worry about the safety of their communities.

Linked with serious crime

Across the country, these highly territorial gxxgs have been linked with murders, drug trafficking, prostitution, bombings and other violent attacks. They’re known to use intimidation and violence to get what they want. To avoid detection from police, they often enlist the help of other support clubs to create a network.

Biker gxxgs, such as the notorious Hells Angels, have been around, behind the scenes, for decades in this province. It’s only now they’re becoming more noticeable as they are displaying their club colours.

Concerns about outlaw motorcycle clubs in this province have prompted the provincial government and the police to recently establish a joint force operation that aims to combat organized crime and illegal drug activity, often associated with these groups.

The force was responsible for uncovering a drug operation on Kenmount Terrace on July 3.

In the course of their search, more than 30 pounds of marijuana, a small amount of cocaine and cash were discovered.

“Organized crime is a problem throughout the province,” RNC deputy chief Bill Janes told The Telegram.

Drug trafficking appears to be the main focus of these outlaw biker groups, he added.

“When you look into our communities, the most common thing you’ll see are drug traffickers,” Janes said.

“These are profitable ventures, but they can also be involved in fraud and prostitution.”

Boom drawing groups

These groups are becoming more prevalent here, he said, because there’s money to be made as a result of this province’s booming economy.

“They’re driven by profit,” he said. “When an economy is growing, there’s opportunity for legitimate businesses, but also illegal activity.”

He said the violence that sometimes follows these outlaw groups is mostly internal conflicts amongs clubs.

However, he said, bikers use propaganda to mask their criminal activity.

For the most part, bikers’ donations to charities across this province are legitimate.

However, Janes said some outlaw clubs take part in raising money for charities as a way of improving their image in the community.

Well-funded groups

“They’re well-funded organizations,” Janes said. “They try to market themselves, improve their grand name, try and build public support, but at same time they’re committing crimes that harm community.

“They try and affiliate themselves with legitimate groups, riding their coattail. That’s the strategy they use to try and promote their organization.

“But they’re wolves in sheeps’ clothing.”

RCMP Staff Sgt. Jim Power said outlaw groups in this province have become a concern for police.

“We see the history on these groups and some are linked to organized crime,” he said. “As they expand and get more powerful, it becomes a big concern.”

The OMC chapters in this province are in their infancy — having been formed within the last few years — but there has already been incidents that have been linked to biker activity.

The drive-by shooting on Dauntless Street in St. John’s in early June, as well as the fire bombing of a car on Hamilton Avenue shortly afterwards were both suspected to have been biker gxxg related. Sources told The Telegram those incidents were the result of a territorial feud between outlaw biker gxxgs.

The major drug busts, such as Operation Roadrunner and Operations Razorback, which resulted in the arrests of dozens of people police, were believed to have had ties to outlaw biker gxxgs.

In St. John’s, members of the George Street Association recently met with the RNC to express their concerns about gxxg-related activity in that popular downtown area.

Grand Falls-Windsor is believed to be the only place in Atlantic Canada with two one percent clubs. The Outlaws are one of the largest in country, while Bacchus, has been well established for years.

As these OMCs become more prominent in our communities, police are keeping a close eye to these groups to ensure they operate within the confines of the law.

“Whether it’s a riding group or OMC, it’s not illegal to belong to these clubs. By law, they’re allowed,” Power said. “These groups can operate because they travel freely, just like any other person without hindrances.

“But we have an interest in these (one percent) groups. Because they have an identified patch, known to be a one percenter. It’s no secret. They acknowledge the obvious.”

But sometimes, it’s not so obvious. Power said police also keep an eye to groups who aren’t so overt.

“Sometimes it’s one of these things, we will never come out and say they are notified as OMC,” he said. “So, we’re careful how we classify them. They must abide by the same laws by everyone else.”

He said police work in conjunction with police forces across the country to identify outlaw club members. Information is transferred nationally.

However, Power said the public can also help in controlling these groups by refusing to accept them in their communities.

“If these groups are embraced by the community, we may see them flourish,” Power said. “But If the community takes the position, ‘we, don’t want this organization in our community,’ and report any activity, it would depend on the group itself and what’s available for them to achieve their objectives.”

In motorcycle club, Vietnam veterans find open roads and open arms

Only Vietnam War veterans know what they endured in the war and after they came back.

And so a group called the In Country Vets Motorcycle Club, strictly for Vietnam veterans, formed 19 years ago to share a love of riding, support one another and raise money for vets of all wars.

In the past three days, the organization brought to Omaha 135 members from more than 20 states for the group's annual national meeting.

“We're very independent, but we're also very co-dependent on each other,” said Dan “Trash” Strecker, the national vice president from Detroit. The organization “reinforces the bonds that we already had as combat veterans,” he said.

Each member has a “road name,” such as Farmer, Popcorn, Rev Ray or Animal. On their motorcycle vests, each wears a pin depicting a dinosaur, because this, Strecker said, is a “dinosaur club” with no legacy memberships. Once these members die out, the organization will end. The youngest member is 60.

Only those who served a combat tour in Vietnam can belong. Navy veterans who were in the Vietnam theater, or zone, and Air Force veterans who flew in the combat zone also can be members. Strecker said the group obtains each applicant's military record from the federal government to verify that he served in the Vietnam War.

In Country Vets Motorcycle Club raised about $20,000 over the past year from chili feeds, hog roasts, motorcycle poker runs and other fundraisers to give money to American Legion homes, VA hospitals, homeless veterans centers and other veterans' causes.

Strecker said Vietnam War veterans typically arrived in American airports alone from the war, a far different scene from the ceremonies and greetings that have welcomed veterans over the past 20 years from the wars in Iraq and Afghanistan.

Vietnam veterans fought in an unpopular war. Strecker said he changed out of his military uniform and into civilian clothing as soon as he landed in the United States because he anticipated derision.

Roy “Judge” Love of the Elkhorn area, the Nebraska state president of In Country Vets Motorcycle Club, said World War II was viewed as a heroic war and it frustrated him to “get told I wasn't in a real war.”

The wars in Iraq and Afghanistan have brought on a change in attitude toward all veterans, Strecker said, and they now are thanked for their service. Some members of the organization find this odd, Strecker said.

They take more comfort from the presence of others who fought in the Vietnam War. Strecker said: “We wanted to associate with men that went through what we went through.”

Bikers Against Discrimination and the American Biker Culture Center in NY is providing campaign support to the “2 Million Bikers Rally to DC” scheduled for 9-11-2013 after their recent denial of a permit to rally on Washington DC by the National Park Service on what is deemed by the center as “OUTLAWING THE VOICE OF THE BIKER CULTURE” in an extremely biased and discriminatory fashion.
Hank McGrath, Executive Director of B.A.D. and the American Biker Culture Center in Ilion, NY believes the position of the NPS against the 2 Million Bikers Rally is despicable.    ”I was in Washington DC this year to present a clear case of cultural discrimination (NY-Tyler & Peeps case), bias and unjust profiling of those in the American Biker Culture to members of Congress, the Justice Department and the US Civil Rights Commission and presented CLEAR evidence and cases that were undeniable and those folks simply would not budge to offer support of any kind primarily because there is an absolute government agency approved discrimination against anyone who rides a motorcycle and who lives within that culture regardless of who they are, what part of the culture they are in or how so many have served this country, vote, pay taxes and are the back bone of America,” McGrath said. “We need to breed those folks out and raise our own into leadership of this country. SAN FRANCISCO - Judge almost shut down surveillance program, documents show

A federal judge who oversaw a secret U.S. spy court almost shut down the government's domestic surveillance program designed to fight terrorism after he "lost confidence" in officials' ability to operate it, documents released Tuesday show.
U.S. District Judge Reggie Walton issued a blistering opinion in March 2009 after discovering government officials had been accessing domestic phone records for nearly three years without "reasonable, articulate suspicion" that they were connected to terrorism.
Walton said the government's excuse that the program was complicated "strained credulity," and he ordered the National Security Agency to conduct an "end-to-end" review of its processes and policies while also ordering closer monitoring of its activities.
Later in 2009, a Justice Department lawyer reported to the spy court a "likely violation" of NSA surveillance rules. The lawyer said that in some cases, it appeared the NSA was distributing the sensitive phone records by email to as many as 189 analysts, but only 53 were approved by the Foreign Intelligence Surveillance Court to see them.
Judge Walton wrote that he was "deeply troubled by the incidents," which he said occurred just weeks after the NSA had performed a major review of its internal practices because of the initial problems reported earlier in the year.
Walton's dissatisfaction with the Obama administration's handling of the surveillance program are contained in hundreds of pages of previously classified documents federal officials released Tuesday as part of a lawsuit by a civil liberties group.
The Obama administration has been facing mounting pressure to reveal more details about the government's domestic surveillance program since a former intelligence contractor released documents showing massive National Security Agency trawling of domestic data.
The information included domestic telephone numbers, calling patterns and the agency's collection of Americans' Internet user names, IP addresses and other metadata swept up in surveillance of foreign terror suspects.
The documents released Tuesday came in response to a lawsuit filed by the Electronic Frontier Foundation. They relate to a time in 2009 when U.S. spies went too far in collecting domestic phone data and then mislead the secret  Foreign Intelligence Surveillance Court about their activities.
The Obama administration's decision to release the documents comes just two weeks after it declassified three secret FISC opinions -- including one in response to a separate EFF lawsuit in the federal court in Washington. In that October 2011 FISA opinion, Judge James D. Bates said he was troubled by at least three incidents over three years where government officials admitted to mistaken collection of domestic data.

As many of you probably know, the State of California recently passed a law saying a warrant is needed for police to search your cellphone if you are placed under arrest. Policeone.com picked up the story and the police officers who commented on the story let their true feelings on the Constitution be known.
In the story, the author noted that this law, which forces police officers to follow the Constitution, was opposed by The Peace Officers Research Association of California. Why did the oppose it? Well because it threatens their auhtority to do whatever they want, law be damned.
The Peace Officers Research Association of California, which opposed the law, argued: “Restricting the authority of a peace officer to search an arrestee unduly restricts their ability to apply the law, fight crime, discover evidence valuable to an investigation and protect the citizens of California.”
And that is just the tip of the iceberg, the quotes on the PoliceOne website and on their facebook page just go to prove what we already knew, cops are not fans of the Constitution when it comes to restrictions on their authority. These people crave power, whether or not it is why they took the job, the power gets ahold of most officers and like the famous saying “power currupts”

A person arrested loses their fourth ammendment when Peace Officers seize their person and property. Anything found on an arrestee has always been fair game in the courts eyes. If we find counterfeit money in a wallet, a childs porno picture, or narcotics, it was still evidence that was legally obtained by arrest.

Boy am I glad I left California. The whacko legislature and governor know not what they do, unless allowing more criminals to avoid prosecution is their intent. I cannot believe they enacted this law after the California Supreme Court, one of the most liberal in the Country, upheld the search. I started in California and retired from Oregon. I’m truly surprised the liberal Oregon Court (either Court of Appeals, or Supreme Court) didn’t follow California.
I’ve noticed time and time again that anyone that is opposed to something a cop does, or just pisses them off in anyway, is a liberal in the minds of a PoliceOne.com commenter. I’ve yet to figure that out. But before I go on, let’s just take a look at what the US Constitution has to say about searching a persons property
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
This is an amendment that was written because British soldiers and were allowed to search any home they liked, at any time and for whatever reason they wanted. And since many Founding Fathers were smugglers, they did not like this. But if you want to piss off a cop, just quote the 4th amendment. That’s right, a real Californian is against getting a warrant to search someones property, and that is what your cell phone and any other electronic device you have in your car is, your private property. Now not all cops are against the Constitution restricting their path to absolute authority, USO131  is one of the good guys.
When you start eliminating the need for a warrant you start to go down a very slippery slope of the loss of your constitutional rights..
If you can’t wrap your head around what I am saying then wrap it around this… Some one is arrested for DUI and all the contents in their electronic device was downloaded? The key here is the subject was arrested… Their cell phone was searched even when the reason for the arrest had nothing to do with possibly of any evidence to USE AGAINST THEM MIGHT BE ON THAT CELL PHONE…

You want to stand up an applaud the upholding of the constitution? That document which you were, I assume, sworn to uphold?
Tell me, what reason would you have to search an individual’s cell phone for, say, an open container arrest? Are you hoping to find pictures of him imbibing on previous occasions?
We have the fourth amendment, and warrants signed by judges for a reason. The same reason we have the second amendment right to protect ourselves with individual firearms ownership.
Really, folks, I can’t fathom why some of you are so upset by this, unless you are too lazy to put in the extra effort required to protect individual liberty.
And this isn’t a left/right issue. It’s a rule of law issue.
A warrant isn’t always needed, most people are too afraid to say no to an officer, and they know it. One trick cops use all the time, one which I fell for during a traffic stop a few years back, is just simply asking the person if they can search their property, as coolcoin points out

 lets face it, these people who take issues with these type of searches arent hurt or offended by the searches. the ones who take issue with this are the anti leo and/or thuggin gangbangers trying to get out of a charge. if you dont have anything to hide and arent committing any crime, then quess what, you likely wont get searched. keep your nose out of crime and this wont be an issue. the majority of supreme court decisions are made from some thug trying to get out of a charge or some liberal nut case who is super anti-leo

Like I said earlier though, there are good cops who are in favor of this new law, I was unaware there was so many thuggin gangbangers with badges, like Christopher Powell.
some of you are crazy or lazy…how is it anti-le to say that someones cell phone is subject to protections of the 4th ammendment? Ask somebody if you can look at their cell phone, if they tell you no, than get a warrant…if you don’t have PC or enough to get a warrant, then you probably have no business looking anyway.
It’s really scary to see what cops honestly think of this ruling. So many of them are bold enough to come right out and say they don’t want to have to get a warrant to search a persons property, even though they swore to uphold a document that says they do.
But the real problem is that Probable Cause is never really defined in the Constitution. Cops use this all the time, they just saw “I had probable cause to believe that…….” and they can search anything without a warrant.
It’s time to stand up for your rights, if you aren’t already. If you are pulled over, and a cop asks if he can search something (your car, cell phone, laptop, whatever) tell him no. Just be prepared to deal with a pissed off cop, and maybe carry a pocket constitution with you at all times.

Bottom-line, the majority of the cops today are punk ass cowards who are in their line of work because they can prey on civilians. Cops either want to take your money and property or injure you. It’s why they’re cops. Take away their badges and guns and their true pussy character comes out. Ever notice how often lone cops shoot unarmed civilians or that most physical confrontations involve several cops beating the shit out of one person?
That’s because the cops these days are pussies. When I was a kid almost all of the cops were World War II or Korean War veterans. They weren’t afraid to duke it out, one on one with a suspect. They almost never pulled their guns. Nowadays, nothing but a bunch pussies. They will shoot you or gang thump you for looking at them wrong. They will shoot your dog for target practice. Not only are today’s cops sadistic cowards, they also break more laws than the average civilian. And that’s because they think they are superior to everyone else The law doesn’t apply to them. In California, most cops game the system for their own benefit. One example is the well documented phenomena of the majority of cops getting some kind of disability within a year of retirement. That way they pad their already outrageously large pensions with tax free disability payments. In the civilian world that’s called fraud. In the cop world it’s them taking something from civilians that cops are owed because they are superior.
Probable cause was never meant to be read as one term, viewed as reasonable suspicion of any “crime”. The most legitimate way in which we should read that phrase: probably have a cause or the cause is probable. And that one simple way of reading this often misinterpreted clause clears up all the mystery.
A cause in the common law of England meant a cause of action, a suit, a claim. And in these actions one would have to prove up their standing by presenting the corpus delecti, the actual proof of harm or injury. Thus, properly understood and enforced, the probable cause requirement of the 4th Amendment would eliminate the enforcement of virtually all victimless crimes. Too bad, so sad, it ain’t like that.
The blatant misconduct of law enforcement officers is horrifying. These are the people that we trust to uphold the Constitution of the United State of America, protect our civil liberties, and keep order in our society. When any one of them has the audacity to break the trust that has been placed in them by the citizens, it sickens me to my core.
I am all for doing the job that needs to be done, especially in the case of felons. However, what I am NOT a supporter of is the willingness of those sworn to uphold the law to break it. That spells doom and gloom for our nation if we allow those with authority, of any kind, to misuse it and abuse it.
A lawyer once came to speak at my college for Constitution Day. He had recently defended a man charged with murder, who was later found not guilty. When asked why he would choose to defend a person like that, he said, it may have been reprehensible for him to defend a person like that, but just because they are accused of a crime doesn’t mean that they lose the rights afforded to them by the Constitution of the United States of America. It may not always be what’s right, but that’s at least fair.
There should be no isolated incidents,but like you said,there are, most search warrant “probable cause” is gained, when a cop gives a “snitch” a break on an arrest, for information about other “crimes”,and a snitch will stretch the story as much as “it” has too.I’m sure you know the “MAJORITY” of the time,cops word the police report to their benefit. Most judges hand out search warrants like Halloween candy,and thats the real “SOB STORY”. But you believe cops should break the law,in order to enforce it. Bet back in school, when the teacher left the classroom,you filled her in on who did what. Then went home to tell mom your version of how you were, “KICKIN ASS AND TAKIN NAMES” Sorry I’m merely voicing an opinion from the other side.
