Florida - Man Jailed For 180 Days For Refusing To Give Police His iPhone Password

A dangerous precedent has been set involving an iPhone in which people can be imprisoned for doing nothing more than practicing their 5th amendment right. Welcome to the post-constitutional age in America.
Should Americans face jail time for refusing to surrender their passwords to police, or is the request alone a violation of their Fifth Amendment right against self-incrimination? According to one judge in Florida, the former is the correct answer.
Christopher Wheeler, 41, was sentenced to 180 days in jail by Broward Circuit Court Judge Michael Rothschild for failing to reveal the correct passcode to his iPhone.
Wheeler was initially arrested on charges of child abuse in March, after he was accused of hitting and scratching his young daughter. The catch is that police are claiming the evidence of this abuse—multiple photos of repeated injuries to the child—can only be found on Wheeler’s locked iPhone.

After he was held in criminal contempt of court by Judge Rothschild in early May, Wheeler did provide a passcode to the iPhone, it just wasn’t the right one.
“I swear, under oath, I’ve given them the password,” Wheeler insisted when he appeared in court on Tuesday.

Wheeler’s case was determined on the basis of an appeals court decision, which separated the phone’s passcode from incriminating photos or videos located on the device.
In December 2016, the Florida Court of Appeal’s Second District ruled that a passcode is not related to any criminal evidence found on the phone:
 “Providing the passcode does not ‘betray any knowledge [Stahl] may have about the circumstances of the offenses’ for which he is charged. Thus, ‘compelling a suspect to make a nonfactual statement that facilitates the production of evidence’ for which the state has otherwise obtained a warrant based upon evidence independent of the accused’s statements linking the accused to the crime does not offend the privilege.”
As Wheeler was sentenced to 180 days in jail for failing to provide the passcode to his iPhone, another Florida man was facing similar demands. Wesley Victor appeared in court on Tuesday as a suspect in an extortion case that surrounded a sex-tape scandal involving Miami social-media celebrity YesJulz.
In contrast, Miami-Dade Circuit Judge Charles Johnson chose not to hold Victor in contempt of court, ruling that he should not be expected to remember his phone’s passcode more than 10 months after his initial arrest.
Critics of the appeals court decision argue that such a requirement violates the individual’s Fifth Amendment right against self-incrimination.

    “Medical marijuana users cannot be convicted of driving while under the influence of the drug absent proof that they were actually impaired, the state Court of Appeals ruled Thursday.

    In a major setback for prosecutors, the judges pointed out that Arizona, unlike some other states, has no law that spells out that at a certain level of tetrahydrocannabinol (THC) in the blood a person is presumed to be impaired…

    What that means is every case where prosecutors charge a medical marijuana user with breaking the law requires expert testimony to show that particular individual was impaired at that particular level of THC.”

This is a huge win for citizens and for rationality itself, as it negates the government’s assumption that an arbitrary number means a driver is impaired, which provided grounds for criminal conviction.

Nadir Ishak was pulled over in 2013 after his vehicle drifted out of its lane. Instead of invoking his 5th Amendment right to remain silent, Ishak admitted to smoking cannabis that morning when the cop probed him for some sign of “criminal” behavior. The cop said Ishak had bloodshot eyes and “body tremors and eye tremors” during a field sobriety test.

If you are one of the 4,700, or more, motorcycle enthusiasts who have already bought tickets to attend Nashville Bike Week next fall, you might want to reconsider your travel plans and take a shot now at cancelling that charge on your credit card.
The event had been scheduled for Loretta Lynn’s Ranch and Camp Grounds in Hurricane Mills, Tennessee, from September 14 through September 24. Last May, event “promoters,” which as it turns out is a guy named Michael Lewis Leffingwell, promised: “After over five years of planning, we are excited to announce the newest 10-day rally in over 60 years.”
“The scenic state of Tennessee is within hours of more than a dozen other states and with so much to offer, Nashville Bike Week is more than just a rally; it’s an experience.” Leffingwell also promised “101 bands on four stages with nine stunt shows daily.”

Warrants

The event ran into serious headwinds Monday when Loretta Lynn’s Ranch announced it was “cutting ties with Nashville Bike Week” for failing “to meet the financial terms of the agreement.” The same day Humphrey’s County Sheriff Chris Davis announced he had been fielding calls from throughout the East questioning the legitimacy of the event. And the conjunction of those two events set off a press frenzy in East Tennessee.
The Sheriff told WZTV in Nashville that ticket holders had been asking about the  event. “Can we still come? Who do we need to contact? We’re not getting any information from anybody involved.”
The television station tried to interview any of the “promoters” on camera but Leffingwell declined – maybe because he has warrants. According to Nashville’s WKRN, “multiple convictions for fraud and theft, including a federal conviction in Missouri.” WKRN also reports, “authorities have active arrest warrants for Leffingwell for probation violations in Georgia and Missouri. He also has an active warrant in Maury County (Tennessee).”
The event speaks to its customers mostly through its Facebook page. A post on Tuesday claimed Nashville Bike Week had met “all financial obligations” and that the event had fired Loretta Lynn, not the other way around, because the venue wasn’t up to state health standards.
The campground told television station WTVF that Nashville Bike week had never applied for the state permit required for large gatherings.
The numbers for this rally do not add up.  The proposed event has bragged that it might attract 150,000 bikers. Leffingwell told WTVF that he doesn’t need a permit because he has only sold 4,700 tickets so far.

Hiccups

Leffingwell has promised to announce a new location for the event tomorrow. Yesterday and today he published two lengthy press releases on Facebook that said in part:
“Launching a first year event this large is a monumental effort. Naturally there are going to be hiccups and bumps in the road that need to be overcome and we are working hard to make sure they are.”
“Nashville Bike Week, the event, is being organized by a corporation not a person. It began as the dream of one person, but one person couldn’t possibly organize an event of this size, so when the dream started to become reality the corporation was formed to protect everyone involved including our customers, vendors, and the entertainers coming to the event. The corporation has officers, employees, attorneys, accountants, an HR department, and bankers just like most corporations. Everyone at Nashville Bike Week is a salaried or contracted employee. Putting on a major event for the first time from the ground up is a monumental undertaking, and we are bound to make mistakes along the way. There is more to the recent news of our relocation than we can elaborate on for legal reasons, but we aren’t letting that slow us down.”
“We have a secured a new venue and have agreed in principle to the terms of the lease, it is approximately six miles from the previous venue. It is larger, with more usable flat ground, and much better suited to hosting an event of this size with room to grow and some freedom to add infrastructure in the years to come. It is more convenient to hotels, restaurants, and the interstate, and it will be easier to get in and out with multiple entry and exit points and full 4G wireless service from every major provider, something the previous venue was lacking. It has both river access for canoeing, and a creek for tubing, stocked lakes for fishing, and we are excited that as soon as all parties have signed the lease we will be able to announce it complete with maps to show the layout and vision for the new long term home of the event. If you have purchased a wristband it is still valid at the new venue, if you rented a cabin you will still have a cabin at the new venue, if you rented an RV or an RV site you will still have the same level of service you rented at the new venue.”
“We are answering the phones and messages as fast as we can to answer your questions, and if you haven’t gotten through keep trying, we will get to you but in the meantime, get ready, Nashville Bike Week is coming and we are in it for the long haul.”

New Louisiana Law Exempts Motorcyclists From Anti-Masking Arrests

Motorcyclists in Louisiana score a big win! Efforts of motorcycle rights advocates paid off when the Louisiana legislature approved a law exempting “persons driving or riding a motorcycle” from the state’s anti-masking statute. (See Louisiana State Legislature-HB161)

The Louisiana House passed HB 161 on a vote of 95-0 on June 5th, 2017 following a mass majority approval by the state Senate on May 30th, 2017. The legislation is on its way to the Governor’s desk.

The MPP reported in November of 2016, (See “Bikers Arrested for Wearing Bandanas”,November 29, 2016)following a trip to Louisiana as a guest speaker at a Louisiana

Confederation of Clubs and Independents (LCOC&I) meeting, that motorcyclists wearing legal helmets were being arrested for violating a state “Anti-Masking Law” originally intended to deter public acts of terror being committed by the KKK.

This obvious abuse of Louisiana statute was being used as a tool to profile and target motorcyclists, particularly in the Shreveport area.

The MPP provided a legislative proposal to Louisiana ABATE and the LCOC&I advocating an amendment to Louisiana’s anti-masking law exempting individuals wearing state approved safety gear while riding their motorcycles for the 2017 session.



Louisiana motorcyclists followed through and successfully lobbied their legislators proving that grassroots political rights movements can be effective and achieve results very quickly when mobilized and organized. The MPP congratulates and commends these efforts because they serve as an example and a model for other states attempting to combat motorcycle profiling and discrimination in all of its various forms.

Nashville Bike Week promoter Michael Lewis “Mike” Leffingwell, who also answers to Mike Axle and Christopher Ashley, photo above, remains incarcerated in the Warren County Regional Jail in Bowling Green, Kentucky today after his arrest Monday.
Leffingwell is a convicted conman who had outstanding warrants for his arrest in Kentucky, Tennessee, Georgia and Missouri. He had previous convictions for theft and perjury. In a 2006 fraud case, Leffingwell agreed to a plea agreement that sentenced him to 30 months in  prison; three years supervised release and 500 hours in a residential substance abuse program. He also agreed to pay his victims $249,000 in restitution.

He is being held without bail.

Long Con

Leffingwell has been selling tickets to his proposed event for the last 13 months. At least 4,700 people have bought advance tickets for what Leffingwell  has been calling “the newest 10-day rally in over 60 years.” Leffingwell claimed Nashville Bike Week would begin next September 14 and continue through September 24  Leffingwell, in an interview with Nashville television station WTVF, is the source for the 4,700 ticket sales statistic. He has also claimed to expect total attendance at the rally to exceed 150,000.
“The scenic state of Tennessee is within hours of more than a dozen other states and with so much to offer, Nashville Bike Week is more than just a rally; it’s an experience.” Leffingwell has written. His gullible victims expected to enjoy “101 bands on four stages with nine stunt shows daily.”
Nashville television station WZTV is reporting that Leffingwell “has already received more than a million dollars in ticket sales.”
In March Leffingwell claimed to have invested $900,000 in the proposed event. At the same time he said, “After discussing it with our attorneys, there is no refunds. Sell your ticket if you don’t want to come…. I don’t want you at our event if you are a whiner and a crier. How can you even ride a bike if you act like that?”
The scam began to unravel last February when Loretta Lynn’s Ranch and Camp Grounds in Hurricane Mills, Tennessee announced it was “cutting ties with Nashville Bike Week” for failing “to meet the financial terms of” an “agreement.”

Stop Believing

Last month, Leffingwell claimed to have a deal with the Opryland Hotel. After Opryland backed out he claimed to have a deal with a local campground.
Then he announced on Facebook, “As of Today due to Opryland Hotel and the Campground being harassed they Both have pulled out. Nashville Bike week has met with attorneys today and The Bands, Entertainment, staging, Vendors have been paid or paid in full. Which leads to option 1 let the Haters win and File Bankruptcy and everyone loses. Option 2 -Get us a place to throw this party! Option 3- Take legal hard against all parties involved ruining this event. We chose 2 and 3 ! We have figured out the permits as long as we don’t camp anymore than 5,000 on site over 18 hours we are good to go.”
Leffingwell did not explain why Nashville Bike Week would have “haters.”
Just today, the Nashville Bike Week Facebook page told ticket holders:
“DO NOT BELIEVE WHAT THE NEWS IS TELLING YOU. It is all FALSE.”
“Everyone who actually purchased a ticket KNOWS 10 day general admission including primitive camping as never costed more than $225 ( not including tax), and was even less expensive if you purchased tickets at an early bird rate. I also feel our camping accommodations were made more than affordable as you can also see below a 10 day 30 amp electric spot only costed $329.25. For the entertainment we have lined up for our customers, tickets and camping accommodations were made very reasonable!!!
“With that being said, we have a new venue locked down. A major announcement will be made very soon, but please trust and listen to what we the promoters and people putting this event on are telling you. We are the individuals working every day to put this on. I do not know why the media is so against us but enough is enough. STAND WITH US!!!! We are going to have one hell of an event!!!

High Fructose Corn Syrup Has Been Quietly, Deceitfully Renamed

High fructose corn syrup now goes by a new name - "Natural Sweetener" - designed to trick customers into making bad choices.

High fructose corn syrup is a killer. Since humans started consuming it, obesity rates have more than tripled and diabetes incidence has increased more than seven fold. Even when used in moderation it is a major cause of heart disease, obesity, cancer, dementia, liver failure, tooth decay, and more.
So what does the FDA do about this silent killer? It allows food producers to change the name of the infamous sweeter in order to trick consumers into thinking they are not eating high fructose corn syrup.
That’s right, high fructose corn syrup now goes by a new, deceitful name – “Natural Sweetener” – designed to trick customers into making ill-informed choices that will impact on their health.
Consumers are finally catching on to the fact that what we put in our mouths effects our waistline as well as our health. Since consumers have become much smarter and finally waking up to these realities, they are demanding healthier food choices. Every food company is smearing 100% natural on every box of anything regardless of whats inside the box.
Now we have to know the new sneaky name to know whether or not we are consuming High Fructose Corn Syrup or not. Obviously the best way to avoid this mess is to buy from companies you really trust.
Big food companies are hiding ingredients they know we really don’t want to consume in their products. This time it’s the presence of a new version of high fructose corn syrup. But this is not the innocuous fructose that has sweetened the fruits humans have eaten since time began. This is a questionable ingredient with many names that could be causing all sorts of health problems.
The product is General Mills’ Vanilla Chex, an updated version of the Chex cereal sold in most conventional grocery and discount stores for many years. The front of the box clearly states that the product contains “no high fructose corn syrup” (HFCS), but turn it over to read the ingredient list and there it is – the new isolated fructose.
Why is that a problem? According to the Corn Refiners Association (CRA), there’s been a sneaky name change. The term ‘fructose’ is now being used to denote a product that was previously known as HFCS-90, meaning it is 90 percent pure fructose. Compare this to what is termed ‘regular’ HFCS, which contains either 42 or 55 percent fructose, and you will know why General Mills is so eager to keep you in the dark.
CRA explains:
A third product, HFCS-90, is sometimes used in natural and ‘light’ foods, where very little is needed to provide sweetness. Syrups with 90% fructose will not state high fructose corn syrup on the label [anymore], they will state ‘fructose’ or ‘fructose syrup’.”

And the way that they get away with this is fairly simple:
Simply eliminating the high fructose corn syrup designation for the laboratory sweetener that’s nine-tenths fructose and calling it what it really is: fructose. And that’s how a processed-food product like Vanilla Chex that contains “fructose”, a substance that, according to the corn refiners, used to be called HFCS-90, can now declare itself to be high fructose corn syrup-free.
