Police Promise to Extort, Kidnap, or Lock You in a Cage for Warming Up Your Car
Roeland Park, KS — Recently in a number of US states, police have been writing people tickets for letting their cars warm up in the morning.
Not only are police extorting people for this common practice, but they have also been rummaging through people’s vehicles as a “demonstration” to show them how easily someone could steal their cars or belongings. Ironically the laws are said to be intended to prevent thieves from breaking into cars while the police are doing the job for them instead.
In Roeland Park, violators could face fines of up to $125, and in just a two-hour time span last week, one officer wrote nine tickets to people who had their cars running.
Officer John DeMoss of Kansas spoke to reporters about how he rummaged through vehicles without the permission of the owners.
Your car can be stolen in a matter of seconds. During my recent enforcement I did stop, go up to the vehicle and look inside the car or open the door and a lot of times the owner of the car never came outside to contact me and say hey what are you doing around my car? That’s plenty of time for somebody to steal your vehicle,” DeMoss said.
Not only is the law itself a violation of free choice and personal responsibility, but this cop just blatantly admitted to searching people without permission! This admission was entirely overlooked by the local news source that broke the story. Instead, they went into stolen car statistics in an attempt to give support for this insane law.
Sadly, Kansas isn’t the only place with laws against warming up your car, it is also illegal in Texas, Maryland, Ohio, West Virginia, Colorado, Wisconsin, South Carolina, as well as several cities in Minnesota. Other states like Alaska have similar laws, but they are targeted at emissions instead of car thefts.
The fines that people receive for the offense vary from state to state.
Knowing that all fines issued by police are ultimately enforced, and their compliance mandated, through the promise of violence — the act of warming up your car on a cold winter morning, could end in your death.
Sure this may seem extreme, however, there are far too many examples of such horrendous responses from the state for people refusing to be extorted.
Last year, a Texas woman failed to pay a ticket for a rolling stop. Sarah Boaz was then kidnapped, stripped naked, and thrown in a cage. Had she physically resisted her kidnappers, she would have been beaten or killed.
A Jasper Texas woman, Keyarika Diggles, also had an unpaid traffic ticket. Her refusal to pay resulted in her being beaten, strip-searched, and dragged around like an animal by two police officers. She was left for hours in a jail cell in a pool of her own blood.
In July, a Pennsylvania man, 38-year-old Kevin McCullers, was shot four times by police fulfilling their promise of violence for refusal to pay traffic tickets. He may never walk again.

Brother

The word "Brother" has become very abused in the motorcycle world these days.  Seems like if you buy a bike and a new set of leathers, everyone else that rides has now become your brother.  Some call it Brotherhood when sharing the wind on two wheels.  Some call it brotherhood when you ride a few roads together.  Just what truly is brotherhood?

There are Brothers in Christ.  Brothers in Masonic temples.  Brothers in several organizations.   Elite military units commonly form a brotherhood among the members of squads.  Navy Seals for example, are more than the sum of their individuals.  They become more than just a team.  They become brothers, totally committed to one another up to and including giving their lives for one another if necessary.  Men that have shared combat together have formed such close relationships as to call each other brother. While these are no less committed than any other Brotherhoods, when it comes to the motorcycle world, there is also a very strong bond among those that call themselves Brothers. 

What is a Brother in the MC world? 

Once you've gone through the hangaround period, the members of the Club have viewed your behavior, your attitude, your dedication, trust and loyalty, to be there.  If you've actually completed this period, then you may be asked to become a prospect.  During this time you are put under a much more intense review.  You and the other members of the club find out if you are suited to be a part of the club and if you can accept the other members as Brothers just as much as if they can accept you and call you Brother.  Can you dedicate yourself to the others as close as you would your own flesh and blood? Many times it is an even closer commitment than family.  The person that you call Brother becomes family as a part of his as well as you being a part of theirs.  A common phrase used in MC circles is  ”I am my Brother’s keeper”.  This means you will support him and help him any way you can, sometimes to the point of selling your bike to help him, quitting your job to go help him and, in some cases, Brothers have even done things that they already know could get them put in jail because they were willing to take that step to help a Brother out.

With all that commitment, it’s also that you would not ask a Brother to do something drastic without very good cause.  Brothers may disagree, but they will always respect one another and treat each other with respect.

Please take note that if you haven't had any experience being around some of the more serious MC's (1%, support clubs, etc.), they take the word "Brother, or Bro" very serious, and they'll only use the word as a show of respect towards their own club, their members, and any club who they've also bestowed that word upon. 

And if a club overhears someone throwing around the word lightly within their midst, it could cause them to aggressively educate those whom they felt disrespected them by abusing the word.


Next time you feel the need to call someone Brother or Bro, just what is behind it?  Commitment or just trying to sound cool?

The prospect./probate
For a prospect its simple, Keep your mouth shut, never discuss club business with anyone, and the reality is a prospect is the bottom of the chain. To be really good, learn all members names, Easy, learn their occupations, hobbies, etc, A club is a brotherhood so be a brother, also make sure you are available for all events, all prospects are expected to do as they are told or instructed, that's a given.  IF a officer needs his back watched at a outing or a run, or a brother is broke down at 2 am, just be there. The more you do the easier it is to become a member.  You are being watched and it will be noticed, always remember as a prospect you have no rank or privileges, and upon introducing yourself  to any patch holder. You must only introduce yourself as a prospect of the ****** Motorcycle club, and keep all other conversation to a minimum, its time to start thinking of a road name. We will pick a name and it will be who you are when in club attire. The road name will be short and describe your personalityor something that happens to you are  that you do that the Patch Holders think would be an appropriate road name. If your probate time gets extended it means you have screwed up, and you should talk to your sponsor. Prospecting should not be looked at as a necessary evil, but a labour of love. All the horrific shit you,ve heard about initianation or rite of passage ritual from prospect to member is true. Good luck.
PS, Never leave a patch holder anyplace, never ever, especially out of town always stay to the end. Unless you have a extreme reason, like your family has a emergency.  Parents or children. ( Family ) remember all PH are brothers. Respect is the biggest lesson some guys have to learn..

MC Club Basics

The Club
The intent of this section is to give you an overview of the structure and philosophy of the traditional motorcycle club (MC). This does not necessarily express the feelings or priorities of any particular club, as all motorcycle clubs differ on some points. Regardless of the basic philosophy of this group, it is important that you understand the perspectives of other clubs that you may be associating with from time to time.
If motorcycles influence your lifestyle, then you are part of the motorcycle community. Of all the types of organizations found within that community, the traditional motorcycle club stands apart and ranks highest in stature.

Respect
A serious MC club commands respect for one reason. Those who are correctly informed recognize the deep level of personal commitment and self discipline that a man has to demonstrate and sustain in order to wear a patch. They realize that a club's "Colors" are closely guarded and the membership process is long and difficult. Other factors notwithstanding, they respect Patchholders for what they have accomplished by being able to earn and keep the patch they wear. This is respect born out of recognition of dedication and accomplishment. The MC Club strives for respect for this reason. This is especially true as it pertains to those persons outside of the motorcycle community. This segment of society is by far the larger, and therefore represents a larger market for any fund raising activities that the group might undertake. It stands to reason that cultivating a relationship with these people is important, and to be perceived by them as "Biker Scum" would not be advantageous to the group. They will therefore conduct themselves as upstanding citizens in every way... "Good neighbors" so to speak. The goal is to be admired and respected by the general public rather than feared. The serious club, and all of its members and guests, will always conduct themselves publicly in a highly professional manner.

Club Colors
The general public does not draw a distinction between different club colors. In many cases, they simply can't tell the difference: we're all "Biker Scum" to them. If one club causes a problem that touches the public sector, the offending club's identity is either confused or ignored and the heat comes down on all clubs. The general public does not make the distinction between a MC and an RC (Riding Club), therefore EVERYONE needs to be aware that no matter whether they are in an MC and RC or an Independent rider, their actions reflect on all in the motorcycle community.  The MC clubs tend to police themselves to avoid such incidents.

Participation
A Patchholder will not discuss any club business whether it's about membership numbers, club goings on, or any member's personal information with anyone outside of the club. They understand that they are a Patchholder 24 hours a day whether or not they are wearing their colors. Everything they say or do in public can affect the club. They also understand that if they get out of line, that they are subject to be counseled for their own good and for that of the club. Wearing a patch is more than getting together for good times. It also means getting together for the other times, too. It constitutes a lot of work. It's committing themselves to a lifestyle in which they do not look for how their brothers or sisters can help them, but for ways that they can be of help to their brothers and sisters. They always look to give rather than to receive. All of this may seem very idealistic, and in some cases it's just that. But it is an ideal that all clubs profess and are always striving for in principle and practice.
Always be aware of the "Golden Rule" of conduct while traveling in club circles: If you give respect, you'll get respect. If you act with disrespect, then you'll be treated with the same.

Levels of Commitment
When someone earns their patch, it does not mean that he or she has reached the ultimate goal and from that point they can kick back and coast. Moving from guest to probation to Patchholder is not climbing from the bottom to the top, but rather more like climbing a constantly ascending slope, and in time becoming a stronger and more committed brother or sister. A person's probationary rocker and later their patch are merely presented in recognition of what they have demonstrated along the way. In this fashion, the more senior the Patchholder is in the club and the more they experience, the more of a brother or sister they should be to all.

Purpose of Probation / Prospecting
Probation is not an initiation, as you would find in a fraternity. It is instead a period of time that is sustained until the person, in every sense, conducts themselves with the respect that is mandated to be a Patchholder. It's a time in which:
The attitude is conditioned so that he/she displays a sense of responsibility and respect toward the patch holders of the club, without which they will not develop a sense of respect for the group.
He/she is educated in basic MC protocol and etiquette.
He/she is given time to develop the habits that are basic to good security and good communications.
To get into the habit of participating.
To become accustomed to trusting the judgment, at times blindly, of those patch holders who will someday be his or her brothers and sisters.
The list could go on but the point here is to demonstrate that probationary period has definite objectives and that a person will go nowhere in the club if he/she is not aware of this and does not apply themselves to those ends. It's not possible to make a checklist of what is expected from a person in all cases. There isn't any formula for success, but the key is ATTITUDE AND RESPECT. Everything else can be learned in time, but a person's attitude comes from the heart.

Knife Carry Laws in California

California law makes it illegal to possess and carry certain types of knives. Many are confused as to what types of knives are legal, and which types are illegal. For purposes of this blog we will seek to shed some light as to what constitutes legal carry of knives.
Per the penal code there are many types of “knives”, each with it’s own description and set of laws. These include, ballistic knives, switch blades, folding knives, dirk or dagger, belt knives, assisted opening knives, disguised knives etc. As a general rule of thumb, most exotic types of blades are outright illegal for the common citizen to possess, sale, manufacture, etc. See California Penal Code Section 12020(a)(1) for detail.
What Types of knives can be legally carried?
The three most common types of knives are folding knives, switch blades and fixed blade knives also know as dirks or daggers. We will define each type of knife and explain the laws surrounding them.
Folding knives are knives that “opens with one hand utilizing thumb pressure applied solely to the blade of the knife or a thumb stud attached to the blade, provided that the knife has a detent or other mechanism that provides resistance that must be overcome in opening the blade, or that biases the blade back toward its closed position” . All folding knives are legal. California Penal Code Section 17235. As long as they are in the folded position they can be carried in a concealed manner. There is no blade length restriction per the penal code.
Switch blades are generally defined as knives that look like folding knives but lack the above elements. (thumb stud, bias toward the closed position etc). They include spring blades, snap blades, gravity knives or any knife which can be opened automatically. Automatically, meaning by a mechanism, spring, gravity, flick of the wrist etc. The blade must be 2 inches in length or longer in order to be classified as a switch blade. Switch blades are illegal to sell or give away. They are illegal to carry in public, concealed or open. Penal Code section 17235.
For fixed blades (known as a dirk or dagger), or a folding knife in the open and locked position, they must be carried “openly”. California Penal Code section 16470 classifies a dirk or dagger as a knife or instrument with or without a hand guard that is capable of ready use as a stabbing weapon that may inflict great bodily injury or death. Per the penal code there is no length limit as long as it is carried openly. A knife carried in a sheath that is worn openly suspended from the waist of the wearer is considered open carry and is legal. Penal code section 20200. Carrying a concealed dirk or dagger is illegal pursuant to Penal Code Section 12020(a)(4).
There are restrictions as to carrying knives when entering schools, Universities and Colleges, and Public buildings open to the public such as courts, city halls, police stations etc. For Schools K-12, no knives with blades longer than 2.5 inches are allowed unless they are required for particular work type duties. Razor blades and box cutters are also prohibited. Penal Code section 626.10. For colleges and Universities, no fixed blades bigger than 2.5 inches are allowed. However there is no restriction on folding knives as long as they don’t fall under the category of switch blades. For state or local public buildings, it is illegal to carry any knife with a blade of more than 4 inches onto the premise. California Penal Code Section 171b.

The Irish Slave Trade – The Forgotten “White” Slaves The Slaves That Time Forgot.

During the 1650s, over 100,000 Irish children aged 10 to 14 were taken from their parents and sold as slaves in the West Indies, Virginia and New England. In this decade, 52,000 Irish (mostly women and children) were sold to Barbados and Virginia. Still 30,000 Irish men and women were also transported and sold to the highest bidder. In 1656, Cromwell ordered that 2000 Irish children be taken to Jamaica and sold as slaves to English settlers. Many people today avoid calling the Irish slaves called what they really were: Slaves. They use words such as "indentured servants" to describe what happened to the Irish. However, in most cases from the 17th and 18th centuries, Irish slaves were nothing more than human cattle.

They came as slaves; vast human cargo transported on tall British ships bound for the Americas. They were shipped by the hundreds of thousands and included men, women, and even the youngest of children. Whenever they rebelled or even disobeyed an order, they were punished in the harshest ways. Slave owners would hang their human property by their hands and set their hands or feet on fire as one form of punishment.
They were burned alive and had their heads placed on pikes in the marketplace as a warning to other captives. We don’t really need to go through all of the gory details, do we? We know all too well the atrocities of the African slave trade. But, are we talking about African slavery? King James II and Charles I also led a continued effort to enslave the Irish. Britain’s famed Oliver Cromwell furthered this practice of dehumanizing one’s next door neighbor. The Irish slave trade began when James II sold 30,000 Irish prisoners as slaves to the New World. His Proclamation of 1625 required Irish political prisoners be sent overseas and sold to English settlers in the West Indies.
By the mid 1600s, the Irish were the main slaves sold to Antigua and Montserrat. At that time, 70% of the total population of Montserrat were Irish slaves. Ireland quickly became the biggest source of human livestock for English merchants. The majority of the early slaves to the New World were actually white. From 1641 to 1652, over 500,000 Irish were killed by the English and another 300,000 were sold as slaves. Ireland’s population fell from about 1,500,000 to 600,000 in one single decade. Families were ripped apart as the British did not allow Irish dads to take their wives and children with them across the Atlantic. This led to a helpless population of homeless women and children. Britain’s solution was to auction them off as well. However, in most cases from the 17th and 18th centuries, Irish slaves were nothing more than human cattle. As an example, the African slave trade was just beginning during this same period. It is well recorded that African slaves, not tainted with the stain of the hated Catholic theology and more expensive to purchase, were often treated far better than their Irish counterparts. African slaves were very expensive during the late 1600s (50 Sterling). Irish slaves came cheap (no more than 5 Sterling). If a planter whipped or branded or beat an Irish slave to death, it was never a crime. A death was a monetary setback, but far cheaper than killing a more expensive African.
The English masters quickly began breeding the Irish women for both their own personal pleasure and for greater profit. Children of slaves were themselves slaves, which increased the size of the master’s free workforce. Even if an Irish woman somehow obtained her freedom, her kids would remain slaves of her master. Thus, Irish moms, even with this new found emancipation, would seldom abandon their kids and would remain in servitude. In time, the English thought of a better way to use these women (in many cases, girls as young as 12) to increase their market share: The settlers began to breed Irish women and girls with African men to produce slaves with a distinct complexion.
These new “mulatto” slaves brought a higher price than Irish livestock and, likewise, enabled the settlers to save money rather than purchase new African slaves. This practice of interbreeding Irish females with African men went on for several decades and was so widespread that, in 1681, legislation was passed “forbidding the practice of mating Irish slave women to African slave men for the purpose of producing slaves for sale.” In short, it was stopped only because it interfered with the profits of a large slave transport company. England continued to ship tens of thousands of Irish slaves for more than a century. Records state that, after the 1798 Irish Rebellion, thousands of Irish slaves were sold to both America and Australia.
There were horrible abuses of both African and Irish captives. One British ship even dumped 1,302 slaves into the Atlantic Ocean so that the crew would have plenty of food to eat. There is little question that the Irish experienced the horrors of slavery as much (if not more in the 17th Century) as the Africans did. There is, also, very little question that those brown, tanned faces you witness in your travels to the West Indies are very likely a combination of African and Irish ancestry. In 1839, Britain finally decided on it’s own to end it’s participation in Satan’s highway to hell and stopped transporting slaves. While their decision did not stop pirates from doing what they desired, the new law slowly concluded THIS chapter of nightmarish Irish misery.
But, if anyone, black or white, believes that slavery was only an African experience, then they’ve got it completely wrong. Irish slavery is a subject worth remembering, not erasing from our memories. But, where has this ever been taught in our public (and PRIVATE) schools???? Where are stories of Irish Slavery in the history books? Why is it so seldom discussed? Do the memories of hundreds of thousands of Irish victims merit more than a mention from an unknown writer? Or is their story to be one that their English pirates intended: have the Irish story utterly and completely disappear as if it never happened. None of the Irish victims ever made it back to their homeland to describe their ordeal.

Here's a thought to warm some of your hearts....

Hi Yanks, I thought you all would like to see the real
figures from Down Under. It has now been 12 months since gun owners in Australia were forced by a new law to surrender 640,381 personal firearms to be destroyed by our own
government, a program costing Australia taxpayers more than $500 million dollars.

The first year results are now in:
Australia-wide, homicides are up 6.2 percent,
Australia-wide, assaults are up 9.6 percent;
Australia-wide, armed robberies are up 44 percent (yes, 44 percent)!
In the state of Victoria.....alone, homicides with firearms are now up 300 percent.(Note that while the law-abiding citizens turned them in, the criminals did not and criminals still possess their guns!)
While figures over the previous 25 years showed a steady
decrease in armed robbery with firearms, this has changed drastically upward in the past 12 months, since the criminals now are guaranteed that their prey is unarmed.There has also been a dramatic increase in break-ins and assaults of the elderly, while the resident is at home.
Australian politicians are at a loss to explain how public safety has decreased, after such monumental effort and expense was expended in 'successfully ridding Australian society of guns....'
You won't see this on the American evening news or hear your governor or members of the State Assembly disseminating this information.
The Australian experience speaks for itself. Guns in the hands of honest citizens save lives and property and, yes, gun-control laws affect only the law-abiding citizens.

Understanding the 1% Rule: Motivations

1percenterpatch_2What motivates the people who make up the content contributors found in "The 1% Rule?" Perhaps the following story offers some clues. (This is an excerpt from our forthcoming book "Citizen Marketers.")
As a patch, it’s pretty simple: A diamond shape surrounded by a blue border, with "1%" embroidered in the middle. It's worn over the heart by members of motorcycle clubs that celebrate their outlaw status from mainstream motorcycle society. They call themselves the "One Percenters."
The inspiration for the patch and its meaning can be traced to 1947, when members of the Pissed Off Bastards of Bloomington motorcycle club and the Boozefighters Motorcycle Club, showed up in Hollister, California, for that town's annual motorcycle race. As parties involving beer in summer heat sometimes do, things got out of hand.
A photographer for Life magazine happened to be attending the race and snapped a picture of a drunken biker perched atop a Harley Davidson, surrounded by broken beer bottles. The photo was published in Life with a caption that read, "Cyclist's Holiday: He and Friends Terrorize Town." A brief story accompanying the photo said 4,000 members of a motorcycle club were responsible for destructive mayhem. The photo and story provoked the American Motorcyclists Association to denounce the boozed-up bikers. It assured worried citizens that 99 percent of its members were law-abiding citizens, thereby marginalizing the remaining "1 percent" as outlaws.
The story has been the inspiration and founding principle for outlaw motorcycle clubs around the world. One Percenters organize and wear their patches as the proverbial finger raised toward society’s expectations of them. For decades, the story of what happened in Hollister has been repeated by numerous writers in magazines and newspapers, codifying its legend.
William L. Dulaney, a visiting professor at Western Carolina University spent months researching the history of the One Percenters for the academic periodical, "The International Journal of Motorcycle Studies." From months spent conducting field research around the United States, and having spent years as a member of an outlaw motorcycle club himself, he argues that contemporary One Percenters in "outlaw" motorcycle gangs are not necessarily pro-criminal, they are anti-bureaucracy. They rebel against the commonality of mainstream expectations.
Furthermore, the One Percenter clubs are organized around the idea of a community, and their unconventional lives and motorcycle lifestyles are reinforced by the strong-as-steel bonds with other members. They revel, sometimes raucously in beer-soaked pandemonium, in a culture that conventional society frowns on. Forget seeking the approval of conventional governing bodies; the One Percenters revel in their minority status.
They are outlaws of culture.
Dulaney surprises us, though, by debunking parts of the Hollister legend. The photo of the drunken biker? The Life photographer staged it. There was rowdiness in Hollister on that fateful weekend, but police made only one arrest. And there’s no evidence the American Motorcyclists Association denounced the bikers, one percent or otherwise. The source of "1%" was likely due a letter to the editor that Life ran in a subsequent edition, taking the magazine to task for its coverage of Hollister. The letter writer wrote, "We regretfully acknowledge there was disorder in Hollister – not the acts of 4,000 motorcyclists, but rather of a small percentage of that number." Someone, somewhere, interpreted that to mean one percent and it stuck.
Even if the facts about Hollister were off, its premise still resonated with a slice of American culture. Today, earning a One Percenter patch is a badge of social status that continues on in a tiny number of American motorcyclist communities.
That's why their story seems to be an apt analogy to describe a good deal of citizen marketers and their motivations, like someone who spends years blogging about Netflix, or campaigns to bring back a discontinued soda, or takes over the marketing for an upcoming movie, or volunteers to secret shop their favorite fast food chain, or anyone who contributes time and attention to a commercial cause. They, too, are outlaws of culture.
What they do is beyond the norm. Sometimes there is little recognition, but they are dedicated to and protective of their work and the community they're involved in. They excel on the edges of culture even if their percentage as content creators is little more than a rounding error to some companies. Numbers-wise, they are not huge, but the impact of their work can be.

Videotaping Police - Arizona bill would bar public from videotaping police

PHOENIX -- A state lawmaker wants to make criminals out of some people who take videos of cops questioning or arresting someone.
The proposal by Sen. John Kavanagh, R-Fountain Hills, would bar shooting video within 20 feet of any "law enforcement activity'' unless the officer first gave permission. A first offense would carry a $300 fine, with subsequent violations potentially sending someone to jail for up to six months.
Daniel Pochoda with the American Civil Liberties Union, says SB 1054 is a violation of First Amendment rights. And attorney Daniel Barr who handles media issues questioned the need for such a restriction.
But Kavanagh, a retired police officer, insisted he's not trying to cloak law enforcement activity from public view.
He said people are free to stand 21 feet away. And he rejected contentions that someone standing that far back might not be able to record important details, like whether someone was reaching for a gun or a cell phone.
"Most cameras have great resolution where you don't really lose anything when you're 20 feet away,'' Kavanagh argued. "At 20 feet you can pretty much pick up small objects.''
What's behind the measure, he said, is the safety of police officers who may be doing anything from questioning a suspicious person to making an arrest.
"Having one or more persons suddenly walking up behind and around them with cameras is a distraction,'' Kavanagh said.
"The officer doesn't know if this is somebody who's a friend of the individual he's doing law enforcement action against or what,'' he continued. "But it distracts the officer which creates a safety problem for the officer.''
"So we're going to make it a crime?'' Barr responded.
"If you're actually interfering with them in some way, interfering with his movement or something like that, I can see that you can be sanction for that,'' he continued, saying there already are laws on the books to cover that situation. "Whether you're filming him or not has nothing to do with it.
Kavanagh disagreed, insisting that those trying to get videos are a special problem.
"They aren't just standing or walking by,'' he said.
"With video, you stand near and you point and you change your perspective to get a better shot,'' Kavanagh continued. "It's a much more intimate interaction than an ordinary citizen watching the cops do something.''
Pochoda said the whole question of what might distract a police officer ignores the underlying issue.
"There is a clearly established First Amendment right for citizens -- or anyone, you don't have to be a citizen -- to record public activities of law enforcement,'' he said. "You don't have to be a professional journalist to possess this First Amendment right.''
He acknowledged that courts have allowed infringements on that right, but only if there is a "demonstrable need.''
"You can't just have this automatic arbitrary number,'' Pochoda said, referring to that 20-foot video-free zone. He said those who interfere with police can always be detained.
"There's nothing magic about 20 feet, that you'll always be interfering if you're less than 20 feet and never if you're past 20 feet,'' Pochoda said.
He also said that, as crafted, the measure could totally obliterate the right of individuals to videotape police activity if the only way to record it is to be within 20 feet, such as an arrest in an alley.
Barr said there's another particular flaw in the proposal.
As written, it would make a criminal out of those who take out a cell phone to videotape their own questioning by police as, by definition, they would be within 20 feet of what's happening.
Kavanagh, however, doesn't see that as a problem, saying there's no inherent right to videotape your own interaction, particularly if that's an arrest.
"If you're the subject of a law enforcement activity, you've got to submit to the authority of the police officer, put your hands on the car, keep your hands out of your pocket,'' he said. "You don't pretend that the cop's not there so you can do whatever you want.''

But Kavanagh conceded that an absolute ban on taping one's own interaction with police might not be justified if an officer is simply asking questions. He said it might be necessary to amend his legislation when it comes up for a hearing.
