Justices Rule Police Do Not Have a Constitutional Duty to Protect Someone..

WASHINGTON, June 27 - The Supreme Court ruled on Monday that the police did not have a constitutional duty to protect a person from harm, even a woman who had obtained a court-issued protective order against a violent husband making an arrest mandatory for a violation.
The decision, with an opinion by Justice Antonin Scalia and dissents from Justices John Paul Stevens and Ruth Bader Ginsburg, overturned a ruling by a federal appeals court in Colorado. The appeals court had permitted a lawsuit to proceed against a Colorado town, Castle Rock, for the failure of the police to respond to a woman's pleas for help after her estranged husband violated a protective order by kidnapping their three young daughters, whom he eventually killed.
For hours on the night of June 22, 1999, Jessica Gonzales tried to get the Castle Rock police to find and arrest her estranged husband, Simon Gonzales, who was under a court order to stay 100 yards away from the house. He had taken the children, ages 7, 9 and 10, as they played outside, and he later called his wife to tell her that he had the girls at an amusement park in Denver.
Ms. Gonzales conveyed the information to the police, but they failed to act before Mr. Gonzales arrived at the police station hours later, firing a gun, with the bodies of the girls in the back of his truck. The police killed him at the scene.
The theory of the lawsuit Ms. Gonzales filed in federal district court in Denver was that Colorado law had given her an enforceable right to protection by instructing the police, on the court order, that "you shall arrest" or issue a warrant for the arrest of a violator. She argued that the order gave her a "property interest" within the meaning of the 14th Amendment's due process guarantee, which prohibits the deprivation of property without due process.
The district court and a panel of the United States Court of Appeals for the 10th Circuit dismissed the suit, but the full appeals court reinstated it and the town appealed. The Supreme Court's precedents made the appellate ruling a challenging one for Ms. Gonzales and her lawyers to sustain.
A 1989 decision, DeShaney v. Winnebago County, held that the failure by county social service workers to protect a young boy from a beating by his father did not breach any substantive constitutional duty. By framing her case as one of process rather than substance, Ms. Gonzales and her lawyers hoped to find a way around that precedent.
But the majority on Monday saw little difference between the earlier case and this one, Castle Rock v. Gonzales, No. 04-278. Ms. Gonzales did not have a "property interest" in enforcing the restraining order, Justice Scalia said, adding that "such a right would not, of course, resemble any traditional conception of property."
Although the protective order did mandate an arrest, or an arrest warrant, in so many words, Justice Scalia said, "a well-established tradition of police discretion has long coexisted with apparently mandatory arrest statutes."
But Justices Stevens and Ginsburg, in their dissenting opinion, said "it is clear that the elimination of police discretion was integral to Colorado and its fellow states' solution to the problem of underenforcement in domestic violence cases." Colorado was one of two dozen states that, in response to increased attention to the problem of domestic violence during the 1990's, made arrest mandatory for violating protective orders.
"The court fails to come to terms with the wave of domestic violence statutes that provides the crucial context for understanding Colorado's law," the dissenting justices said.
Organizations concerned with domestic violence had watched the case closely and expressed disappointment at the outcome. Fernando LaGuarda, counsel for the National Network to End Domestic Violence, said in a statement that Congress and the states should now act to give greater protection.
In another ruling on Monday, the court rebuked the United States Court of Appeals for the Sixth Circuit, in Cincinnati, for having reopened a death penalty appeal, on the basis of newly discovered evidence, after the ruling had become final.
The 5-to-4 decision, Bell v. Thompson, No. 04-514, came in response to an appeal by the State of Tennessee after the Sixth Circuit removed a convicted murderer, Gregory Thompson, from the state's death row.
After his conviction and the failure of his appeals in state court, Mr. Thompson, with new lawyers, had gone to federal district court seeking a writ of habeas corpus on the ground that his initial lawyers had been constitutionally inadequate. The new lawyers obtained a consultation with a psychologist, who diagnosed Mr. Thompson as schizophrenic.
But the psychologist's report was not included in the file of the habeas corpus petition in district court, which denied the petition. It was not until the Sixth Circuit and then the Supreme Court had also denied his petition, making the case final, that the Sixth Circuit reopened the case, finding that the report was crucial evidence that should have been considered.
In overturning that ruling in an opinion by Justice Anthony M. Kennedy, the majority said the appeals court had abused its discretion in an "extraordinary departure from standard appellate procedures." Chief Justice William H. Rehnquist and Justices Scalia, Clarence Thomas and Sandra Day O'Connor joined the opinion.
In a dissenting opinion, Justice Stephen G. Breyer said the majority had relied on rules to the exclusion of justice. Judges need a "degree of discretion, thereby providing oil for the rule-based gears," he said. Justices Stevens, Ginsburg and David H. Souter joined the dissent.

Does your dog bark? Barking can have serious consequences!
 

Excessive barking is probably the most common behavior problem in dogs. 


 

 Excessive barking results in dogs being abandoned and destroyed by the truckload. People can't cope with it and they can't seem to prevent it, they can't manage to solve it, and they usually don't under-stand it. So they wind up getting rid of the dog. Perhaps they are forced to get rid of the dog. Perhaps they are forced to get rid of their dog by justifiably angry neighbors or worse yet by the courts. Perhaps they get rid of their dog out of desperation or out of anger. The point is that the dog gets "the gas chamber," through no fault of his own.
One question you should be asking yourself, is "why do dogs bark anyway?" Some vocalizations that dogs make are motivated by the need to communicate. For example, a puppy's barking can also mean "I am angry, scared, frustrated, lonely, happy, protective, or want attention." The meaning of the vocalizations depends on the circumstance and the type of bark.
However, barking can become a trained behavior. If you say a word like "speak" just before your dog is about to bark and then reward him with food or play, he will learn to bark on command. This can be helpful, especially when teaching a dog to bark intelligently; that is, at the right time.
Barking can also become an unintentionally trained behavior. Let's say that you yell "shut up" when your dog barks. When yelling doesn't work, you give him a dog biscuit or throw a ball to keep him quiet. Your reasoning is that your dog won't bark while he is eating or playing. You are right, but what you are really doing is training your dog to bark to get his reward of food or play.

You can unintentionally train a dog to be a barker in other ways, too. Let's say your dog is frustrated in his attempts to get you to let him out. So he barks out of frustration. You let him out to keep him quiet. You are training your dog to bark when he wants out. This could be a fine skill if it's limited, but if your dog wants to go out frequently, your dog: and his barking can become a real nuisance.
A dog's barking can also become a problem if you don't intentionally control the learning situation. What happens if your dog is penned up or tied up in your back yard and passers-by taunt him or kids tease him? The dog barks. The passers-by go away or the kids run away, and the dog is rewarded for barking. With a few experiences like this, your dog will begin to bark at all passers-by. Your dog can easily become a nuisance barker in this environment. This problem behavior is an improperly learned and misplaced watchdog skill. You may think your nuisance barker is a "good watchdog" but he isn't really. Remember the story of the boy who often cried "wolf?"

Some dogs learn to start barking when they hear the door close as their owners are leaving. Some wait until they hear or see the family car drive away. Some look out the window, watch their loved ones, and only start their lamentable chorus when they are out of sight. Such refined discrimination is the sign of a very advanced skill.
How do they learn this Skill of incessant barking? Let's look at it from the dog's perspective. You go out the door and close if. The dog is frustrated by the barrier. He barks, you open the door and calm him down, barking is rewarded. Or, your puppy is put in the den or a crate. He barks, you let him out. Barking is rewarded. Or your dog feels afraid when he is left alone. He barks for help. You come and console him. Barking is rewarded.

Rod and I had just been speaking with property owners along the edge of the lake. We had permission to be there. These officers forced us to stop filming. Literally. The officer on the right ripped my iPhone from my hands and drew down on me with a taser. As of this day, April 17, 2013, I have uttered the words, "Don't tase me bro."

After a 20 minute lecture about the dangers of snakes, ticks, various and sundry other warnings about spending the afternoon in jail, we tried to leave. That's when a Mayflower police officer issued Rod a citation for a) Parking in a Prohibited Area and b) Interfering with a Government Operation.

A government operation? That pretty much takes the cake. The only posted sign anywhere NEAR this section of Lake Conway is a red tape between a few trees which reads: "DANGER"

Funny way for the government to cordon off its "operations". Maybe it's just me, but concerned citizens documenting an oil spill are being fined. What will Exxon's fine be for the wholesale destruction of wetlands vital to the Lake Conway ecosystem?

Back on the 10th of April Copblock posted the story Officer Safety – Mobile Phones as Weapons, once again it seems that we have members of the law enforcement community attempting to infringe on the 1st Amendment rights of Americans.

The new $100 bill: Same old face, with some high-tech tweaks meant to thwart counterfeiters.
After a three-year hiatus due to production delays, Americans will finally be getting the new $100 bill in their ATMs and bank accounts on October 8, the Federal Reserve said Wednesday.
The new bill will have several features the Fed says will make life difficult for counterfeiters, but should help retailers identify fakes.
They include a blue, 3-D security ribbon embedded with images of bells that change to the number 100 when you tilt the note back and forth. If you tilt it side to side, those images move up and down.
There also will be a Liberty Bell embedded in an inkwell on the face of the note. Both are copper colored until you tilt the note. Then, the bell will change from copper to green.
The Fed spells out all the cool features on its website. The $100 bill, the most widely-counterfeited U.S. note, was last redesigned in 1996. The Fed says you will not need to trade in your old $100 notes for the new ones.
One thing that isn't changing: Benjamin Franklin's visage will still be staring out at you as you help the U.S. economy by handing him over to a cashier. But he won't be winking.
 

TENN - Man Dies in Police Raid on Wrong House, Unfuckingbelievable. Based on the words of a snitch.

"A 61-year-old man was shot to death by
police while his wife was handcuffed in another room during a drug
raid on the wrong house.
Police admitted their mistake, saying faulty information from a drug informant contributed to the death of John Adams Wednesday night. They intended to raid the home next door." 
  The two officers, 25-year-old Kyle Shedran and 24-year-old Greg Day, were placed on administrative leave with pay.
“They need to get rid of those men, boys with toys,” said Adams’ 70-year-old widow, Loraine.
John Adams was watching television when his wife heard pounding on the door. Police claim they identified themselves and wore police jackets. Loraine Adams said she had no indication the men were police.
“I thought it was a home invasion. I said ‘Baby, get your gun!,” she said, sitting amid friends and relatives gathered at her home to cook and prepare for Sunday’s funeral.
Resident Fired First
Police say her husband fired first with a sawed-off shotgun and they responded. He was shot at least three times and died later at Vanderbilt University Medical Center in Nashville.
Loraine Adams said she was handcuffed and thrown to her knees in another room when the shooting began.
“I said, ‘Y’all have got the wrong person, you’ve got the wrong place. What are you looking for?“‘
“We did the best surveillance we could do, and a mistake was made,” Lebanon Police Chief Billy Weeks said. “It’s a very severe mistake, a costly mistake. It makes us look at our own policies and procedures to make sure this never occurs again.” He said, however, the two policemen were not at fault.
The Tennessee Bureau of Investigation is investigating. NAACP officials said they are monitoring the case. Adams was black. The two policemen are white.
Family members did not consider race a factor and Weeks agreed, but said the shooting will be “a major setback” for police relations with the black community.
“We know that, we hope to do everything we can to heal it,” Weeks said.
Johnny Crudup, a local NAACP official, said the organization wanted to make sure and would investigate on its own.
Weeks said he has turned the search warrant and all other evidence over to the bureau of investigation and District Attorney General Tommy Thompson. A command officer must now review all search warrants.

NEVEDA - DA won’t file charges against ex-Boulder City police chief over email flap

Boulder City’s former police chief Thomas Finn will not face criminal charges for allegedly deleting emails related to preparation for the Mongols Motorcycle Club and directing the staff to do the same.

A Clark County District Attorney's Office report released Tuesday concluded that there was not enough evidence to indicate a specific intent to commit a crime to charge Finn for deleting emails. The district attorney’s office said Finn’s cooperation with the investigation supports his claim that he was trying to prevent the accidental dissemination of sensitive information.

“At first, the email seemed unusual,” District Attorney Steve Wolfson said. “However, when the city actually received a public records request, Finn and the city provided the documents requested. In fact, Finn contacted the city’s IT manager to make sure that backup computer files were searched for emails that may have been deleted from his individual inbox.”

The Mongols Motorcycle Club filed a complaint in October alleging that Boulder City Police targeted members for harassment during the national meeting in June and tried to destroy evidence of possible civil rights abuse.

The allegations of deleted records stemmed from an email Finn sent to various law enforcement partners days before the Mongols arrived for its national meeting. In the email, Finn asked staff members to delete emails regarding preparations for the Mongols visit to keep the safety plans confidential should the Mongols submit a public records request, the report said.
Months after a peaceful Mongols’ national meeting, Stephen Stubbs — a Las Vegas tax attorney representing the Mongols — made a formal public records request.

After the request, Finn also asked the police department’s IT division how he could recreate or download the deleted files, the report said.

The Mongols — a motorcycle club known as the “Baddest 1 percenters” — had been involved in a deadly riot at the Laughlin River Run in 2002 with the Hells Angels. Finn said the directions to delete emails were made to ensure the safety plans were not compromised and the residents were safe should an incident occur.

He also added that he wanted to prevent staff members leaving the plans open on their computer.

“What I really wanted to do was to get that information off the work station computers to minimize the chance of someone who was not authorized to view it and then disseminate it into the community,” Finn said in an interview with attorney general’s investigator Tony Kotlarz.

The report states that Finn’s actions didn’t indicate an overt intent to commit a crime by destroying records.

After following rec.knives for a while, it became obvious that a quick summary of knife laws would be handy. Here's what little I've been able to glean from my reading.
My goal is to find the clear portion of what is flat-out legal and easily summarized. I realize most states confuse the issue unmercifully; I'll let others figure out how to push the limits.
WARNING: This document is created from hearsay and whatever laws I could find. For legal advice, ask a lawyer. I could be lying. I only provide this to try to slightly improve the general lack of information on this subject. YOU are responsible for your own actions. If you don't know exactly what the laws are for any state or locale you are in, GO FIND OUT. (http://www.ncsl.org/public/sitesleg.htmis a good start, containing pointers to all state legislative sites.) I haven't updated this for a while, so consider it a cursory guide.

Explaination

State (hyperlink goes to detailed explaination)
  • Summary:

  • Basically, I want to answer the question "I'm flying to state X tomorrow, so which knife can I take?"
  • Max length:

  • Size limit, measured the most unpleasant way possible. Some may permit longer in certain cases, but I won't suggest anything longer if it's in a gray area.
  • Specifically illegal:

  • Specific styles which are explicitly forbidden.
    Switchblade= Push a button/lever, it does the rest.
    Gravity knives = Opened by gravity or centrifigual force. Butterfly knives (balisongs) included.

BTW So many places forbid sharp things in schools that this sentence is the only place I'll mention this: assume posession of knives in schools - even colleges - is illegal.
Use this as guidance: kids have been suspended for mere posession of nail clippers.


US Knife Law Summary

  • Ballistic knives (automatic blade throwers) are prohibited.
  • Switchbladesmay not be transported/mailed across state lines unlessthe recipient intends to use it for military use.
  • Possessing a knife in a federal facility is prohibited unless it is a pocket knife with blade under 2.5".

Arizona
  • Summary: Generally clear. Illegal to carry "deadly weapon, (except a pocket knife) concealed."
  • Max length: None apparent.
  • Relevant laws: ARS book
California
  • Summary: Anything capable of ready use as a stabbing weapon is illegal. All concealed knives are a felony (except non locking folders).
  • Max length: chaotic
  • Specifically illegal: Switchblades, gravity knives, exotic conceal methods (pen, lipstick, whatever)
  • Relevant laws: PC 653K, PC 12020(24), California Laws, Commentary (apparently removed - someone know where?)
    • Note that interpretations by cops and judges are wildly varied. Police have actually told law-abiding citizens to break the concealment laws, and a judge has deemed a blunt-point knife (Spyderco Mariner) a stabbing weapon.

Existing As A Motorcycle Club!
As the days go by, I see more and more injustice done to motorcycle club members. There are many who are always ready to stand and fight for their rights, while many others could give a shit less! I have had many laugh at me when I say motorcycle clubs need to unite in order to save themselves from a complete ban across the country. People tell me their is just too much hatred between a lot of the motorcycle clubs! The fights between the MC's are what the government is using to slowly destroy all MC's! There are real wars going on all over the world you never see on TV at all! Why is it that when two different MC members get into a fight it is on every news channel and in every paper? More often then not there is some TV docudrama made about it!
I look at the MC's out there and there are some that I do not like, their values and beliefs are not the same as I believe a motorcycle club should be! I believe in the ole skool values of brotherhood, loyalty, freedom. If I have something, my brother too has that something! I believe if someone starts a fight with my brother they are starting a fight with us both! I do not believe in robbing and stealing to get what I want! I do not believe a motorcycle club member should use his MC membership to bully and extort people! Most MCs Share these beliefs but there are shades of grey in some areas and some times a small difference can mean a lot. The Value of Brotherhood is held the same by almost every MC out there! The love of the motorcycle and the feelings we feel while riding these motorcycles with our brothers as a motorcycle club are felt the same by just about all of us! Most of our core beliefs are very similar if not exactly the same! The point I am trying to make is that the MC's out there that you and I may not like is much closer to what we are then these out-of-control government agencies that are trying to destroy all of us!

I am reminded of the scene in the Movie Braveheart where hundreds of different Scottish Clans come together. Some got along, others did not and yet others outright hated each other and would fight on sight to the death! If you or I where to take a look at two of these clans that hated each other, it would probably take a long time for us to figure out what their differences were. To us these clans would appear the same! There came a time for these clans when the grip of England that had slowly been growing tighter around the necks of all of them reached a point where the leaders of these clans realized they would rather live with people who may not agree with everything they do, but at least they could understand their values! I am sure this choice was easier to make when everyone knew the only other choice was to watch as they were are all slowly destroyed one by one and erased from history!

This is the Point where American Motorcycle Clubs are now at! We do not need to like each other and we can even still hate each other! But we must work together before it is too late! There are countries around the world that have already banned motorcycle clubs all together! MC members who hated each other yesterday are finding respect for each other as they fight side by side for their simple right to just exist!!!

We know what the road ahead of us holds. Do we just continue riding till we get there or do we begin preparing for the storm ahead?

Three area offices to open an hour earlier to accommodate customers
California Department of Motor Vehicles (DMV) says its Escondido field office at 725 North Escondido Boulevard will close permanently on Friday, May 10.
The office will be closed until new space can be acquired, which is expected to take approximately nine months.
Three nearby offices will open an hour earlier each day beginning Wednesday, May 1, to accommodate customers.
DMV offices opening an hour earlier starting May 1:
•Poway, 13461 Community Road’
•Oceanside, 4005 Plaza Drive; and
•Temecula, 27851 Diaz Road.
Poway, Oceanside, and Temecula office hours will be Monday, Tuesday, Thursday, and Friday from 7 a.m. to 5 p.m. and Wednesday, 8 a.m. to 5 p.m. while an Escondido office is closed.
Customers can also transact business online. Online services available 24 hours a day, seven days a week through its website include appointments for written and drive tests; vehicle registration and driver license renewals, selection of personalized license plates, changes of address, and payment of fees via secure debit transactions.
Customers can also call DMV customer service at 800-777-0133.

LAS VEGAS - Bikers Could Soon be Splitting Lanes

LAS VEGAS -- Lane splitting is one step closer to becoming legal in Nevada with the practice already legal in states like California.
An amateur YouTube video is posted to demonstrate how lane splitting is done and it's a practice that some bikers use to squeeze through traffic that's not moving as fast as it should.
Wayne Flora is a biker and he's against any laws that would make lane splitting legal.
"Cars typically don't pay attention enough to watch for bikes to start with," Flora said. "A 3,000 pound car versus my leg, I'll stay in my lane."
Flora said all it takes is one move or lane change for a driver to send a biker crashing to the ground.
Chris Gibson drives his truck everywhere and even though it's illegal, he's seen bikers on the I-15 freeway maneuver their way through rush hour traffic.
"It's more of a safety hazard than it is an easement for the motorcyclists to get around," Gibson said. "I'm white knuckled, because I fear for that man's life because if he goes down, he's going to get hurt."
Whether Assembly Bill 236 is passed or not, Nevada Highway Patrol Trooper Loy Hixson said bikers are still going to take the gamble.
"The biggest thing is, it's unsafe," Hixson said. "They will take that chance and they will do it because it will help them get to their destination quicker."
The bill has already passed the Assembly as it now heads onto the Senate.
Another part of this bill is that bikers can't go more than 10 miles an hour faster than the cars they're passing.
